Definitions
In these Terms & Conditions:
- Magna Mediaworks refers to Magna Mediaworks, a sole proprietorship registered in Surakarta, Central Java, Indonesia.
- Client refers to any individual or organisation purchasing or requesting our services.
- Agreement refers to the accepted quotation, proposal or written agreement between Magna Mediaworks and the Client.
- Services refers to all creative production services provided by Magna Mediaworks.
- Deliverables refers to all final photographs, videos, edited content or other agreed project materials.
Applicability
These Terms & Conditions apply to all quotations, proposals, agreements and services provided by Magna Mediaworks unless otherwise agreed in writing.
Quotations & Project Confirmation
All quotations are non-binding until accepted in writing.
A project is considered confirmed only after:
- the quotation or agreement has been accepted in writing by the Client;
- where applicable, both parties have signed the agreement; and
- the required deposit has been received.
Until these requirements have been met, Magna Mediaworks reserves the right to decline or reschedule the project.
Deposits & Payments
A deposit of 50% of the agreed project price is required to secure the production date.
Travel-related expenses, including flights, accommodation and other agreed travel costs, are invoiced separately and must be paid in full before any bookings are made.
The remaining balance is payable within 14 days after completion of the project.
Final photographs, videos or other deliverables will only be released after full payment has been received.
Failure to pay within the agreed period may result in delayed delivery until all outstanding invoices have been settled.
Changes to the Project
Any changes requested after the Agreement has been confirmed may affect pricing, production schedules and delivery dates.
Additional work will always be discussed and approved before it is carried out.
Revisions
Unless otherwise agreed, every project includes two revision rounds.
Revision rounds apply only to changes within the original project scope.
Additional revisions or requests outside the agreed scope may incur additional charges, which will always be discussed with the Client before work begins.
Unused revision rounds cannot be exchanged for discounts or additional services.
Delivery
For most standard productions, delivery is expected within approximately two weeks after production.
Larger productions, including documentaries, YouTube series and long-form projects, are delivered according to a mutually agreed production schedule.
Delivery times are estimates and may vary depending on project complexity, client feedback and circumstances beyond our reasonable control.
Final files are delivered securely via WeTransfer unless otherwise agreed.
Client Responsibilities
The Client agrees to:
- provide accurate project information;
- supply required materials on time;
- obtain any necessary permissions or permits;
- ensure timely communication and feedback.
Delays caused by the Client may affect production schedules and delivery dates.
Travel Expenses
Projects requiring travel outside the Surakarta region may incur additional travel expenses.
Travel costs, including transportation, accommodation and other agreed expenses, will be specified in the quotation and must be paid before travel arrangements are confirmed.
Cancellations
Projects may be cancelled without cancellation fees up to 14 days before the scheduled production date.
Travel expenses that have already been incurred, including booked flights or other non-refundable reservations, are not refundable.
Hotel accommodation will be refunded only if cancellation is accepted by the accommodation provider.
If the Client cancels:
- between 7 and 14 days before production, 25% of the total project value remains payable;
- within 7 days before production, the full deposit is non-refundable.
Copyright & Usage Rights
Unless otherwise agreed in writing, Magna Mediaworks retains the copyright to all original photographs, videos and creative works.
Upon full payment, the Client receives the agreed licence to use the final deliverables for the intended purpose.
Unless the Client explicitly objects in writing before production begins, Magna Mediaworks reserves the right to use completed work for its portfolio, website, social media, promotional materials, competitions and other marketing purposes.
RAW Files & Project Storage
RAW photographs, RAW video footage and other source files remain the property of Magna Mediaworks.
Where available, RAW files may be supplied as an additional service at an additional cost.
Project files are securely stored for six months after delivery.
After this period, Magna Mediaworks cannot guarantee recovery or re-delivery of project files.
Licensed Music
All music used in our productions is obtained through properly licensed sources.
Any licence restrictions imposed by the music provider remain applicable after project delivery.
Drone Operations
Drone operations are subject to Indonesian aviation regulations, local restrictions, weather conditions and safety requirements.
If drone flights cannot legally or safely be performed, Magna Mediaworks may use alternative filming methods without liability.
Artificial Intelligence
Magna Mediaworks may use AI-assisted technologies to support editing, transcription, subtitling, voice enhancement and other post-production processes.
All creative decisions and final deliverables remain under the supervision of our production team.
Force Majeure
Neither party shall be liable for delays or failure to perform obligations resulting from circumstances beyond reasonable control, including but not limited to:
- severe weather;
- heavy rainfall;
- volcanic eruptions;
- earthquakes;
- government restrictions;
- illness;
- strikes;
- equipment failure;
- transportation disruptions;
- other unforeseen events.
Where possible, both parties will work together to reschedule the production.
Limitation of Liability
Magna Mediaworks shall not be liable for indirect, incidental or consequential damages arising from the use of our services.
Our total liability shall never exceed the total amount paid by the Client for the specific project giving rise to the claim.
Governing Law
These Terms & Conditions are governed exclusively by the laws of the Republic of Indonesia.
Both parties agree to first attempt to resolve any dispute through mutual consultation.
If no amicable solution can be reached, disputes shall be submitted to the competent courts of Indonesia.
